Vaughan McLean Partner Mitchell Waldman, Esquire of the law firm’s Atlantic City office was successful in obtaining a verdict in favor of the plaintiffs after a four-day jury trial in the Superior Court of New Jersey, Law Division, Cape May County. The matter involved a dispute between two property owners over a bulkhead which spans the two bay-front properties. The verdict was rendered in favor of the plaintiffs in the amount of $160,973.91.
After deliberating for approximately one hour, the jury found that the defendant(s) maintained a nuisance on their property. The nuisance, consisting of the defendants’ failure to install the adjoining bulkhead in a soil-tight condition, caused soil to wash out from the plaintiff’s property. The jury awarded full damages for the cost of repairs.
