Partner Mitchell Waldman Obtains Dismissal with Prejudice of NJLAD Lawsuit

Mitchell Waldman, Esquire, in a case captioned “Mann v. Cape Insulation”, held in the Superior Court of New Jersey, Law Division, Docket No. CPM-L-333-21 has obtained a dismissal of plaintiff’s Complaint, with prejudice. The lawsuit, filed by the Law Offices of Eric A. Shore alleged violations of the New Jersey Law Against Discrimination. The Complaint had been dismissed, without prejudice for plaintiff’s failure to provide discovery. Plaintiff’s counsel withdrew and plaintiff Brian Mann elected to proceed pro se. On November 18, 2022, an Order was entered granting the defendant’s motion to dismiss plaintiff’s Complaint with prejudice. Plaintiff filed a motion to reinstate the Complaint and vacate the dismissal. On December 16, 2022 an Order was entered denying the motion. Plaintiff’s settlement demand in the case was in the amount of $200,000. Neither a motion for reconsideration nor Notice of Appeal was filed in the case.
