In a case captioned “Barbara Tierno and Anthony Tierno H/W v. La Pizza Tega”, venued in the Superior Court of New Jersey, Law Division, Atlantic County under Docket No. ATL-L-1643-18, a defense verdict was rendered on March 14, 2023 after a five day trial which began on March 7, 2023. This matter arises from an incident that plaintiff Barbara Tierno claimed involved a slip and fall at the La Pizza Tega restaurant located in Linwood, New Jersey on July 29, 2017. The defense contended that plaintiff tripped and fell. The jury deliberated for approximately one hour and 20 minutes before rendering the verdict in favor of the defendant, having found that the defendant was not negligent.
At trial, the defense called Roy Friedenthal, M.D. as its medical expert and Joseph B. Mills, P.E. as its liability expert. Plaintiff utilized Zachary Post, M.D. as her medical expert and Ronald Fermano, RA as her liability expert.
Plaintiff Barbara Tierno was claiming an injury to her left knee which consisted of a fractured patella For the fractured patella, plaintiff underwent reconstructive surgery, arthroscopic surgery and a partial knee replacement. Plaintiff’s injuries were not disputed by the defense. However, through Dr. Friedenthal, the defense argued that Barbara Tierno made a good recovery after her surgical procedures.
The trial was held before the Honorable John C. Porto, P.J. Cv. Seven jurors were selected, all seven deliberated. The jury delivered a unanimous (7-0) verdict in favor of the defendant and against the plaintiffs.
