R. Michael “Mike” O’Donnell authored the article “Florida First District Court of Appeals Retreats from Ortiz,” published in the Daily Business Review on July 11, 2024. In the article, Mike discusses the Court’s recent decision in American Airlines Grp. v. Lopez. Signaling their retreat from the 2023 Ortiz ruling, the Court returned to applying a traditional statutory of limitations analysis when determining whether a petition for benefits was filed in a timely manner. The old standard simply states that the two-year running of the statute of limitations starts on the date of the accident, or one year running of the clock from the carrier’s payment of compensation or medical treatment.
