The New York State Workers’ Compensation Board has announced that three new Medical Treatment Guidelines (MTGs) will become effective May 2, 2022, to coincide with the launch of Phase 3 of the OnBoard Program. OnBoard is an online system implemented by the New York State Workers’ Compensation Board that is intended to replace the paper-based claims system with a single, web-based platform. OnBoard Limited Release is scheduled to be released in three phases beginning on March 7, 2022.
These new MTGs define and dictate the standard of care for treating Eye Disorders, Traumatic Brain Injuries and Complex Regional Pain Syndrome. Similar to the previously adopted MTGs, included are directives and guidance for the clinician pertaining to the initial assessment of the injured worker; considerations for proper diagnosis; treatment of the acute, sub-acute and chronic stages of the particular disorder/condition; and determinations regarding a return to work.
Of particular interest are the MTGs pertaining to traumatic brain injuries (including diagnoses of concussion and post-concussion syndrome) and complex regional pain syndrome. Defending and administering claims involving these diagnoses have long been a source of frustration for carriers. The MTGs lay out long-awaited detailed diagnostic criteria and severity classifications that provide for increased objectivity in evaluating these conditions.
