In a case captioned “Samuel Schneider v. Jackson5 Foods, LLC, et al. ”, venued in the Superior Court of New Jersey, Law Division, Ocean County under Docket No. OCN-L-2076-20, associate Lindsay Switzer successfully argued a Motion for Summary Judgment dismissing our client from the case. This matter arises out of a trip and fall sustained by Plaintiff Schnieder on a sidewalk near the boardwalk in Seaside Heights, New Jersey. Jackson5 was the tenant of a building on the boardwalk near where Plaintiff fell.
Oral argument was held on September 8, 2023 before the Honorable James Den Uyl, J.S.C. In granting the motion for summary judgment as to Jackson5 Foods, Judge Den Uyl found that there was no evidence of negligence on behalf of Jackson5 and that, as a tenant, Jackson5 had no control over the maintenance or repair of the boardwalk near its restaurant. Ms. Switzer prepared the motion and argued it before Judge Den Uyl.
